Terms of Use

These Terms of Use ("Terms") are a contract between you and PalTranslate ("PalTranslate," "we," "us," or "our") and govern your use of the PalTranslate: AI Voice Clone mobile application and related services (the "Service"). Please read them carefully. By installing, opening, or using PalTranslate, you agree to be bound by these Terms and by our Privacy Policy.

If you do not agree, do not use the Service.

These Terms incorporate Apple's standard Licensed Application End User License Agreement ("Apple Standard EULA"), available at apple.com/legal/internet-services/itunes/dev/stdeula. Where these Terms and the Apple Standard EULA conflict, these Terms govern as between you and PalTranslate, except where the Apple Standard EULA is required to control.

1. Acceptance and who can use PalTranslate

You may use PalTranslate only if you can form a binding contract with us under the law of your country, and only if doing so is not prohibited by any applicable law. You must be at least 13 years old, or the minimum age required to consent to digital services in your country, whichever is higher.

The Service is currently provided on iOS. PalTranslate does not require a traditional account; we create an anonymous, device-level identity for you (see the Privacy Policy). You are responsible for activity that happens through your device, including any voice recording you submit and any purchases you make.

2. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use one copy of PalTranslate on Apple-branded devices that you own or control, for your personal use, as permitted by the Apple Standard EULA and the App Store Terms of Service.

You may not, except as expressly permitted: reverse engineer, decompile, or disassemble the Service; extract or attempt to extract the underlying models or model weights; scrape or use automated means to access the Service; resell, sublicense, or commercially exploit the Service; circumvent any rate limit, paywall, or restriction; or use the Service to build a competing product or to train a machine learning model.

3. The Service

PalTranslate is a real-time, two-way voice interpreter. With one phone between two people, the app captures microphone audio, transcribes and translates speech, displays live subtitles, and speaks each person's words aloud in the other language. When you enable a voice clone, the app can speak your translated words in your own voice.

We may add, change, or remove languages, voices, models, or features at any time, and may impose limits on session length or usage.

The voice clone is optional. If you choose to create one, you record a short voice sample and we create a personalized synthetic voice ("voiceprint") via our vendor Cartesia. By creating a voice clone, you:

Represent that the voice is your own, or that you are otherwise authorized to use and clone that voice. You may not clone the voice of any other person without their explicit authorization, and you may not clone a voice to impersonate, deceive, defraud, or harass anyone.
Explicitly consent to the processing of your biometric data (the voice sample and resulting voiceprint) for the sole purpose of synthesizing speech in your voice during interpreting sessions, as described in the Privacy Policy.

You can withdraw this consent at any time by deleting your voice clone in the app or deleting your account, which deletes the voiceprint from Cartesia.

5. Acceptable use

You agree not to use PalTranslate to:

Violate any applicable law, or facilitate illegal activity.
Clone or imitate a person's voice without authorization, or create synthetic speech, "deepfakes," or impersonations intended to scam, defraud, impersonate, mislead, harass, or damage anyone's reputation.
Harass, threaten, defame, or abuse any individual or group, or engage in hate speech.
Infringe anyone's intellectual property, privacy, publicity, biometric, or other rights.
Interfere with, overload, or attempt to gain unauthorized access to the Service.

We may suspend or terminate access for violations, with or without notice.

6. Translation-accuracy disclaimer

PalTranslate uses automated speech recognition, machine translation, and synthetic speech. These technologies are imperfect and can produce errors, omissions, or mistranslations, and the synthesized voice may not perfectly reflect tone or meaning.

Translations and transcripts are provided for general, informational purposes only. Do not rely on PalTranslate for any medical, legal, financial, emergency, safety-critical, or other high-stakes communication. For those situations, use a qualified human interpreter or licensed professional. You are responsible for reviewing and verifying any output before relying on or acting on it.

7. Intellectual property

We retain all rights, title, and interest in and to the Service and its software, models, and content, excluding your own content. You retain ownership of your voice sample and voice clone. To operate the Service for you, you grant us a limited, royalty-free, worldwide license to process your microphone audio, voice sample, and voiceprint solely to provide, secure, and improve the Service for you — we do not use them to train general-purpose models and do not sell them. This license ends when you delete the relevant content or your account, except where we must retain it by law.

8. Subscriptions, billing, and free trials

8.1 Paid features

PalTranslate offers auto-renewable subscriptions that unlock premium features. The exact prices, durations, entitlements, and any free allowance or free-tier cap are shown in the app at the time of purchase.

8.2 Apple is the merchant of record

All purchases on iOS are processed through your Apple account using Apple's In-App Purchase system. Apple's terms govern the payment.

8.3 Auto-renewing subscriptions

Subscriptions automatically renew at the end of each billing period for the same length and price (plus applicable taxes), unless you cancel at least 24 hours before the end of the current period. Your Apple account will be charged for renewal within 24 hours of the period ending. You can manage and cancel subscriptions in iOS Settings → [your name] → Subscriptions. Deleting the app does not cancel your subscription.

8.4 Free trials and free tier

If we offer a free trial or a free usage cap, any unused free-trial time is forfeited when you start a paid subscription, and you must cancel before a trial ends to avoid being charged.

8.5 Refunds

All purchases are processed and refunded by Apple. To request a refund, use Apple's "Report a Problem" tool at reportaproblem.apple.com. Except where required by law, PalTranslate does not issue refunds directly.

9. Third-party services

The Service depends on third-party providers including Apple, Google Firebase, Cartesia, Soniox, LiveKit, PostHog, Adjust, Meta, and RevenueCat. Your use of features that rely on those providers is also subject to their respective terms and privacy policies. We are not responsible for the acts or omissions of third-party providers, and outages or changes by them may affect the Service.

10. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PALTRANSLATE DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the Service will be uninterrupted, secure, error-free, or that any translation or output will be accurate or meet your expectations. You use the Service at your own risk.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PALTRANSLATE AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, INCLUDING ANY RELIANCE ON A TRANSLATION OR SYNTHESIZED OUTPUT.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO PALTRANSLATE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the limitations above may not apply to you in full. Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Termination

You may stop using the Service at any time and delete your account in-app. We may suspend, restrict, or terminate your access, in whole or in part, with or without notice, if we reasonably believe you have violated these Terms, if continued provision would expose us or other users to risk, or if we are required to do so by law. On termination, your right to use the Service ends. Sections that by their nature should survive (including 4, 6, 7, 10, 11, 13, and 14) will survive.

13. Changes to these Terms

We may update these Terms. When we make material changes, we will update the "Last updated" date at the top and, where appropriate, notify you in-app. Continued use of the Service after a change means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws principles. If you are a consumer in the European Union, United Kingdom, or another jurisdiction whose laws give you the right to bring claims in your local courts, nothing in this section limits that right.

15. Apple-specific terms

These additional terms apply if you obtain PalTranslate from Apple's App Store, and supplement the Apple Standard EULA:

These Terms are between you and PalTranslate only, not with Apple. Apple is not responsible for the Service or its content.
Apple has no obligation to provide maintenance or support for PalTranslate.
If PalTranslate fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to PalTranslate.
PalTranslate (not Apple) is responsible for addressing any claims relating to the app, including product liability claims, claims that it fails to conform to any legal or regulatory requirement, and consumer-protection claims.
PalTranslate (not Apple) is responsible for the investigation, defense, settlement, and discharge of any third-party intellectual property infringement claim relating to the app.
You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
