Terms of Use

These Terms of Use ("Terms") are a contract between you and Speakey ("Speakey," "we," "us," or "our") and govern your use of the Speakey mobile application and its translation keyboard, together with any related services (the "Service"). Please read them carefully. By installing, opening, or using Speakey, you agree to be bound by these Terms and by our Privacy Policy.

If you do not agree, do not use the Service.

These Terms incorporate Apple's standard Licensed Application End User License Agreement ("Apple Standard EULA"), available at apple.com/legal/internet-services/itunes/dev/stdeula. Where these Terms and the Apple Standard EULA conflict, these Terms govern as between you and Speakey, except where the Apple Standard EULA is required to control.

1. Acceptance and who can use Speakey

You may use Speakey only if you can form a binding contract with us under the law of your country, and only if doing so is not prohibited by any applicable law. You must be at least 13 years old, or the minimum age required to consent to digital services in your country, whichever is higher.

The Service is currently provided on iOS. Speakey does not require a traditional account; we create an anonymous, device-level identity for you (see the Privacy Policy). You are responsible for activity that happens through your device.

2. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use one copy of Speakey on Apple-branded devices that you own or control, for your personal use, as permitted by the Apple Standard EULA and the App Store Terms of Service.

You may not, except as expressly permitted: reverse engineer, decompile, or disassemble the Service; scrape or use automated means to access the Service; resell, sublicense, or commercially exploit the Service; circumvent any rate limit or restriction; or use the Service to build a competing product or to train a machine learning model.

3. The Service

Speakey is an AI translation keyboard. You enable a system keyboard, type in any app, tap Translate, and the line you typed is replaced with its translation. The host app helps you enable the keyboard in iOS Settings and manage your settings and account.

The translation keyboard requires iOS "Full Access" to reach the network and perform translations; see the Privacy Policy for exactly what that means and what data is sent. We may add, change, or remove languages, models, or features at any time, and may impose limits on usage.

4. Acceptable use

You agree not to use Speakey to:

• Violate any applicable law, or facilitate illegal activity.
• Harass, threaten, defame, or abuse any individual or group, or engage in hate speech.
• Infringe anyone's intellectual property, privacy, or other rights.
• Interfere with, overload, or attempt to gain unauthorized access to the Service.

We may suspend or terminate access for violations, with or without notice.

5. Translation-accuracy disclaimer

Speakey uses automated machine translation. This technology is imperfect and can produce errors, omissions, or mistranslations, and may not perfectly reflect tone or meaning.

Translations are provided for general, informational purposes only. Do not rely on Speakey for any medical, legal, financial, emergency, safety-critical, or other high-stakes communication. For those situations, use a qualified human translator or licensed professional. You are responsible for reviewing and verifying any output before relying on or acting on it.

6. Intellectual property

We retain all rights, title, and interest in and to the Service and its software, models, and content, excluding your own content. You retain ownership of the text you submit. To operate the Service for you, you grant us a limited, royalty-free, worldwide license to process the text you ask to translate solely to provide, secure, and improve the Service for you — we do not use it to train general-purpose models and do not sell it. This license ends when the translation is returned, except where we must retain data by law.

7. Pricing

Speakey is currently offered free of charge, with no in-app purchases. We may introduce paid features or subscriptions in the future; if we do, the prices, durations, and entitlements will be shown in the app at the time of purchase, all purchases on iOS will be processed through your Apple account using Apple's In-App Purchase system, and any refunds will be handled by Apple via reportaproblem.apple.com.

8. Third-party services

The Service depends on third-party providers including Apple, Google Firebase, the Google Gemini API, PostHog, Adjust, Meta, and RevenueCat. Your use of features that rely on those providers is also subject to their respective terms and privacy policies. We are not responsible for the acts or omissions of third-party providers, and outages or changes by them may affect the Service.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPEAKEY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the Service will be uninterrupted, secure, error-free, or that any translation will be accurate or meet your expectations. You use the Service at your own risk.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPEAKEY AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, INCLUDING ANY RELIANCE ON A TRANSLATION.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO SPEAKEY IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR USD $50 IF YOU PAID NOTHING.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the limitations above may not apply to you in full. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Termination

You may stop using the Service at any time and delete your account in-app. We may suspend, restrict, or terminate your access, in whole or in part, with or without notice, if we reasonably believe you have violated these Terms, if continued provision would expose us or other users to risk, or if we are required to do so by law. On termination, your right to use the Service ends. Sections that by their nature should survive (including 5, 6, 9, 10, 12, and 13) will survive.

12. Changes to these Terms

We may update these Terms. When we make material changes, we will update the "Last updated" date at the top and, where appropriate, notify you in-app. Continued use of the Service after a change means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws principles. If you are a consumer in the European Union, United Kingdom, or another jurisdiction whose laws give you the right to bring claims in your local courts, nothing in this section limits that right.

14. Apple-specific terms

These additional terms apply if you obtain Speakey from Apple's App Store, and supplement the Apple Standard EULA:

• These Terms are between you and Speakey only, not with Apple. Apple is not responsible for the Service or its content.
• Apple has no obligation to provide maintenance or support for Speakey.
• If Speakey fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Speakey.
• Speakey (not Apple) is responsible for addressing any claims relating to the app, including product liability claims, claims that it fails to conform to any legal or regulatory requirement, and consumer-protection claims.
• Speakey (not Apple) is responsible for the investigation, defense, settlement, and discharge of any third-party intellectual property infringement claim relating to the app.
• You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
